THE EXTENT OF SCHOOL CRIME, THE INTERPRETATION OF CHILDREN'S RIGHTS IN JUVENILE COURT HEARINGS, AND SCHOOL ADMINISTRATIVE DECISIONS THAT DEPRIVE CHILDREN OF THE RIGHT TO EDUCATION ARE CONSIDERED.
Abstract
THE INCIDENCE AND CHARACTER OF SCHOOL CRIME ARE CONSIDERED THROUGH QUOTES FROM VARIOUS STUDIES. THE EVOLVING ROLE OF THE JUVENILE COURTS IN DEALING WITH THE DELINQUENT BEHAVIOR OF YOUTH IS TRACED THROUGH VARIOUS JUDICIAL DECISIONS UP TO THE RECENT GUARANTEE OF THE SAME DUE PROCESS RIGHTS TO JUVENILES THAT ARE ACCORDED ADULTS IN CRIMINAL CASES. EXTENDING DUE PROCESS TO YOUTH FACING THE PROSPECT OF BEING DEPRIVED AN EDUCATION BY SCHOOL OFFICIALS IS ALSO DISCUSSED. NOTIFICATION TO YOUTH AND PARENTS OF AN ADMINISTRATIVE HEARING THAT COULD RESULT IN THE YOUTH'S SUSPENSION FROM SCHOOL IS REQUIRED UNDER DUE PROCESS REQUIREMENTS. THE RIGHT TO A DEFENSE EFFORT IS ALSO GUARANTEED. FURTHER IF A JUVENILE IS REFERRED BY SCHOOL AUTHORITIES TO THE JUVENILE COURT, THE SCHOOL MUST ACCEPT THE JURISDICTION OF THE COURT REGARDING THE DISPOSITION OF THE MATTER. TABULAR DATA ARE PROVIDED.
