GUIDELINES FOR APPLICATION OF THE STATE OF MISSOURI'S REVISED CRIMINAL CODE, DESIGNED FOR USE BY COURT PERSONNEL, ARE PRESENTED; APPROPRIATE CODE CITATIONS ARE INCLUDED.
Abstract
THE MANUAL SERVES AS BOTH A TRAINING AID AND A PROCEDURAL REFERENCE FOR THOSE INVOLVED WITH COURT PROCEDURES. THE 23 CHAPTERS FOCUS ON SUCH SUBJECTS AS PRELIMINARY PROVISIONS; GENERAL SENTENCING PROVISIONS; IMPRISONMENT; PROBATION; FINES; COLLATERAL CONSEQUENCES OF CONVICTION; LIABILITY; JUSTIFICATION; ATTEMPT AND CONSPIRACY; AND HOMICIDE, ASSAULTS, AND KIDNAPPING. ALSO COVERED ARE SEXUAL OFFENSES; PROSTITUTION; OFFENSES AGAINST THE FAMILY; ROBBERY, ARSON, AND BURGLARY; STEALING AND RELATED OFFENSES; WEAPONS OFFENSES; GAMBLING; PORNOGRAPHY; OFFENSES AGAINST PUBLIC ORDER; OFFENSES AGAINST THE ADMINISTRATION OF JUSTICE; OFFENSES AFFECTING GOVERMENT; DRUG OFFENSES; AND MISCELLANEOUS OFFENSES AFFECTING PUBLIC SAFETY. WITHIN EACH CHAPTER, A LOGICAL PRESENTATION IS MAINTAINED. FOR EXAMPLE, SECTION 1.6 STATES THE MAJOR POINT, THAT OFFENSES MUST BE DEFINED BY STATUTE, CITES THE APPLICABLE SECTION OF THE MISSOURI CRIMINAL CODE, QUOTES FROM THE CODE DIRECTLY, AND CONCLUDES WITH A COMMENTS SUBDIVISION WHICH PROVIDES FURTHER CLARIFICATION OF THE MAJOR POINT. THIS FORMAT IS FOLLOWED THROUGHOUT; COMPLEX SECTIONS ARE FURTHER CLARIFIED THROUGH SPECIAL NOTES FOLLOWING THE COMMENTS. SIGNIFICANT CASES ARE ALSO DISCUSSED. THE LOOSELEAF DESIGN ALLOWS UPDATING AND REVISION OF THE MATERIALS, AND THE TABS SEPARATING THE CHAPTERS FACILITATE ACCESS. THE WORK CONCLUDES WITH DEFINITIONS ARRANGED IN ALPHABETICAL ORDER. (LWM)
