This text examines techniques, strategies, and legal restraints facing negotiators in growth management and development negotiations between public and private entities.
Abstract
An overview examines recent trends and issues in bargaining between developers and local governments. The competing objectives that must be considered in negotiating a public-private partnership agreement in large-scale urban development projects also are discussed from both the public and private perspectives. Techniques in negotiating public-private agreements then are illustrated in projects undertaken in Florida, New York, and Texas. Special negotiation strategies are outlined for use with neighborhoods, professional staff of local governments, and in agency-agency and developer-multiple agency agreements. The negotiation process required to gain conditional zoning approval for a mixed-use project in Massachusetts is described; three examples of zoning approval negotiations are provided to illustrate how local, controversial issues may overwhelm the negotiations. Finally, applicable case law is reviewed on public-private negotiations and the resultant agreements. 21 references.
