Three articles on transnational dispute resolution focus on interim relief for international commercial arbitration, the implications of the 1979-1980 United States-Iran dispute for international dispute settlement, and dispute resolution under international tax treaties.
Abstract
The article on international commercial arbitration defines the authority of arbitrators to grant interim relief, especially when expressly designated in contractual language, and considers the extent to which domestic and foreign courts allow arbitration decisions to bind parties to contracts. The article supports a broad definition of arbitral tribunals' powers to grant interim relief in international commercial disputes. Provisional remedies from the courts may be sought while arbitration is pending. Another article examines the response of the U.S. Government to the international crisis precipitated by the seizure of U.S. embassy personnel in Iran in November 1979. This crisis provides a catalog of international dispute resolution mechanisms. The third article examines the role of U.S. competent authorities developed under tax treaties, with primary emphasis on the availability of adjustments which resolve incidences of double taxation.
