This article presents the background of casino gaming in New Jersey, outlines the provisions of the 1977 Casino Control Act which govern casino licensing, and discusses case law decisions which are major precedents for casino gaming.
Abstract
Attending the implementation of the Casino Control Act, the Division of Gaming Enforcement was established to investigate matters associated with Atlantic City casino gaming and to enforce casino law. The division is under the direct supervision of the attorney general. The Casino Control Commission was created to regulate casino gaming. The licensing requirements of the Casino Control Act are the core of New Jersey's regulation of casino gaming. These provisions affect not only casino applications, their owners, officers, directors, and the holding and intermediary companies thereof, but persons who are employed within casino hotel facilities and enterprises which conduct business with those facilities. The licensure requirements list affirmative standards and disqualifying criteria which apply to each type of applicant. Case law has affirmed New Jersey's strict regulation of casino gambling and its efforts to exclude the involvement of persons with criminal backgrounds and questionable associations with organized crime figures. Court opinions affirm that the burden is upon persons who seek involvement in casino gaming to demonstrate their good character, honesty, and integrity. 218 footnotes.
