This book guides advocates and practitioners in the selection, preparation, presentation and effective use of witnesses in arbitration proceedings.
Abstract
Introductory chapters review witness perception, retention, and recall and describe aspects of case review and development (investigating the facts in a case and coordinating case preparation techniques). Guidelines for witness selection address the purpose and function of various witness categories and considerations in selecting witnesses (witness anxiety, intimidation on the stand, memory deficiency, the detection of deception, and the grievant as a witness). The discussion of witness preparation covers the ethics and psychology of prehearing discussions, witness characteristics that may present problems, topics for prehearing discussions, and response instructions to witnesses. Other chapters consider the essential considerations, issues, and procedures of the hearing; witness examination; cross-examination; redirect, recross, and rebuttal; and objections. A 39-item bibliography, a subject index, and appended rules of evidence for U.S. courts and magistrates and voluntary labor arbitration rules of the American Arbitration Association.
