Representatives of the FBI, campus law enforcement associations and agencies, and the National Railroad Passenger Corporation testify in favor of S. 1203, a bill to amend section 534 of title 28, U.S. Code, to allow railroad police and private university or college police access to Federal Government criminal identification records.
Abstract
FBI witnesses represent the Identification Division, Recording and Posting Sections, and the National Crime Information Center. They support the bill based on the view that campus and railroad police perform criminal justice functions pursuant to State law. The FBI witnesses favor a clarification in the bill which would give railroad and campus police access not only to criminal history records but also other records maintained pursuant to 28 U.S.C. 534, including wanted person records and missing person information. Representatives of campus and railroad police support the bill based on their special law enforcement functions pursuant to State law. They note that this bill would not apply to private security police who do not operate pursuant to State law or executive order. Written statements and supplementary correspondence are included.
