Addresses and comments from the 1986 Trans-Atlantic Divorce Mediation Conference provide an overview of divorce mediation in the United States, Canada, and Great Britain and discuss court-annexed divorce mediation programs; private divorce mediation's scope and relationship to formal proceedings; legal and practical issues in divorce mediation; and the qualifications, training, and selection of divorce mediators.
Abstract
Following three addresses on overviews of mediation in the three countries, three addresses cover court-annexed mediation programs. The latter focus on domestic relations mediation in Maine, the interests served by court-annexed mediation programs in Canada, and court-annexed mediation programs in England and Wales. Three speakers review private divorce mediation's scope and relationship to formal proceedings in each of the three countries. An address on the legal and practical issues in divorce mediation in Britain considers the location and occasion of mediation. Speakers also present American and Canadian perspectives on legal and practical issues in divorce mediation. Following three addresses on the qualifications, training, and selection of divorce mediators in the three countries, speakers assess whether divorce mediation is an improvement on traditional formal proceedings and reflect on the benefits of the conference's comparative exchange. Questions and comments from the audience are included along with commentator responses for each topic.
