This document reviews the 19 existing State laws which authorize suspension of a driver's license prior to conviction on a charge of driving while under the influence of alcohol or drugs, and discusses the first and second editions of the Model Revocation on Administrative Determination Law (ROAD) prepared under the National Highway Traffic Safety Administration's sponsorship.
Abstract
The report presents the text of ROAD with comments from State licensing officials and implementation guidelines. It summarizes the laws of 19 States which provide for revocation or suspension on the basis of an administrative determination that the person drove a vehicle while having an unlawful alcohol concentration. These states are Alaska, Colorado, Delaware, District of Columbia, Indiana, Iowa, Louisiana, Maine, Minnesota, Mississippi, Missouri, Nevada, North Carolina, North Dakota, Oklahoma, Oregon, Utah, Washington, and West Virginia. Charts compare individual provisions of these States' laws. The interstate aspects of ROAD are discussed. A paper on the constitutional dimensions of ROAD laws is appended.
