This article argues that there is a movement toward trial court unification in all western societies driven by the exigencies of modern economic organization, but points to distinctive limits imposed on this movement by the political and legal cultures of each society.
Abstract
The American dual system of State and federal trial courts and the current move toward alternative dispute resolution are analyzed in light of this argument. (Publisher abstract)
