This booklet presents a concise set of instructions for police officers to use in the field in complying with the law regarding interrogating suspects and informing them of their Miranda rights.
Abstract
An introduction explains the importance of interrogation and the necessity of following the Miranda rules to assure that statements of the accused are admitted into court. Further sections explain when Miranda rules apply and do not apply, define custody and interrogation, and detail the steps to be used in notifying suspects of their rights, and administering the Miranda warning. Additional guidelines explain the waiver of Miranda rights for adults and juveniles, the preservation of proof of a waiver, what to do when suspects assert their rights, the emergency exception to Miranda, and actions after the suspect has been charged.
