This book provides an overview of Federal constitutional protections and procedure as well as the law of evidence for Federal courts.
Abstract
Constitutional protections and procedure encompass jurisdiction and venue, search and seizure, fifth and sixth amendment protections, immunity in grand jury proceedings, preliminary proceedings, and arraignment and plea. Other constitutional protections apply to pretrial discovery and disclosure, trial discovery of prior statements, joinder and severance, jeopardy and mistrial, and prosecutorial misconduct and vindictiveness. Protections for the accused in trial and post-trial proceedings are also reviewed. The discussion of the law of evidence in Federal criminal proceedings addresses judicial notice, evidence weight and relevancy, demonstrative and documentary evidence, witness examination, privileges, opinion evidence, and hearsay and exceptions. Appendixes contain amendments to the U.S. Constitution, Federal rules of criminal procedure, and the Federal rules of evidence. Chapter outlines, table of cases, table of statutes and rules, and subject index.
