The New York legislature's response to domestic violence has been an attempt to decriminalize spouse abuse. Citing studies show that arresting a batterer reduces recidivism, mandatory arrest legislation is needed that ensures that both the police and the citizenry are made aware that spouse abuse is a crime. Several States have responded to the domestic violence problem by enacting statutes that provide explicit guidance for law enforcement officers, including permissive or mandatory arrest provisions. New York should enact comprehensive domestic violence legislation that directs the response of law enforcement officers, requires greater prosecutorial and judicial responsibility, and provides more protection to victims. 328 footnotes.
