This second of two volumes of the New York State Basic Course for Prosecutors XII covers 11 topics relevant to prosecutorial functions in New York State.
Abstract
The first paper discusses practical evidentiary problems pertaining to the art of objecting, the introduction of recorded tapes at trial, documentary evidence, evidence of other crimes, and the boundaries of cross-examination under the 'Sandoval' decision. This is followed by a monograph that addresses five key questions prosecutors must ask themselves to determine the proper handling of expert testimony on direct examination and cross-examination. A discussion of trial preparation features first steps in trial preparation, the use and development of available information, witness interviews, examination of the departing or absent witness, and finalizing preparation. A paper on procedures prosecutors can use to maximize the effectiveness of police witnesses in street crime cases considers informal education, evidence acquisition, and communication. Other papers provide instruction in insanity-defense law, arson law, robbery, controlled substance and marijuana offenses, warrantless search and seizure, and appellate practice.
