This protocol provides guidelines for the prosecution of felony domestic violence cases by the San Francisco District Attorney's Office.
Abstract
Introductory information emphasizes that domestic violence is criminal conduct that should be responded to in the same way as other violent crimes. The cycle of violence is described in terms of the tension-building, acute battering, and respite phases. Fears of the victim resulting from contact with the criminal justice system are described, as are methods for alleviating them. A definition of domestic violence is provided. Prosecution guidelines cover rebooking/warrant, contact with the victim, declensions, complaints, referral to the Family Violence Project, evidence collection subpoenas, continuances, arraignment and preliminary hearing, charge reductions and dismissals, and sentencing. Handling of reluctant victim/witnesses is discussed, and the need for early and consistent contact with the victim and referral to appropriate support services as a means for protecting the case is emphasized.
