Abstract
A brief history of Canada's rules of criminal procedure discusses a police officer's duties and legal liabilities. Also considered is protection afforded officers under Federal and provincial statutes. The section on arrest explains what constitutes an arrest, provisions of the Charter of Rights and Freedom that guide arrest procedures, arrest with and without warrant, illegal arrest, arresting a youthful offender, and other uncommon situations. Provisions of the Charter that govern search and seizure are reviewed. Among the issues covered are search warrants, search of suspects, seizing goods, solicitor-client privilege, and powers of search under the Criminal Code and other statutes. The handbook's final section focuses on interrogation procedures and a suspect's rights under the Charter. It specifically examines laws concerning admissibility of evidence, the accused's state of mind, taking statements, and introducing such statements at trial. Table of cases and an index.
