This book, intended for lawyers and law students, discusses and compares appellate procedures in Federal and State appellate courts.
Abstract
The book, a second edition, includes changes that have occurred during the past eight years in many courts and concentrates on the practice of civil appeals from lower courts. Part one of the book describes appellate courts and how they function and proposes remedies for dealing with appellate case overloads. Part two focuses on initial considerations before taking an appeal and discusses appealable orders as well as the finality doctrine and its exceptions. Part three outlines procedures for taking appeals from a trial court in the jurisdiction. Part four focuses on preparation of the appeal record and Part five provides details for preparing, organizing, and writing a persuasive appellate brief. Part six discusses the preparation and contents of the oral argument, while Part seven outlines procedures after oral argument, rehearings and mandates and the decisional process. Part eight discusses motion practice. Appendixes include a sample petition, answers to a petition, and a brief.
