The American Legislative Exchange Council (ALEC) presents model State laws in the area of agriculture; banking and financial services; civil justice; education; energy, environment, and natural resources; fiscal responsibility and tax policy; health and welfare; labor; law and justice; State affairs; trade and economic development; and transportation, communication, and public works.
Abstract
The proposed model laws reflect the values of ALEC: the preservation of individual liberty, basic American values and institutions, productive free enterprise, private property rights, and limited representative government. Model laws in the area of 'Law and Justice' pertain to the exclusionary rule, bailable offenses, reduction in frivolous appeals, electronic home detention, and firearms regulation. The model Exclusionary Rule Act provides that evidence should not be excluded from a criminal proceeding if it was acquired by an officer in a reasonable, good faith belief. The Bailable Offenses Act would restrict or deny bail for convicted felons. The Reduction in Frivolous Appeals Act would reduce the number of appeals by convicted persons, and the Electronic Home Detention Act would allow offenders to remain in the community and maintain jobs, pay taxes, and support their families. The model Consistency in Firearms Regulation Act prohibits local governments from passing firearms ordinances so as to provide consistency statewide under State firearms acts.
