This chapter details the provisions of the Federal Comprehensive Crime Control Act of 1984 (CCCA) relating to young offenders and juveniles and focuses on changes in Federal policy regarding the treatment of juveniles and youthful criminals.
Abstract
The 1984 statute repealed the Youth Corrections Act, thereby abolishing all special forms of treatment and release and substituting determinate sentencing administered within sentencing guidelines and Sentencing Commission policy. The statute also provides procedures for prosecuting juveniles as adults and outlines circumstances for withholding the surrender of jurisdiction over young Federal offenders to State authorities. Additional provisions dealing with juvenile records are detailed, along with changes in procedures for juvenile dispositional hearings and detention. Changes made by the 1984 legislation to the Juvenile Justice and Delinquency Prevention Act are outlined as is the Missing Children's Assistance Act authorized by the CCCA. 118 footnotes.
