This discussion of 1988 State and Federal judicial decisions dealing with Sixth Amendment issues and related criminal procedures is directed mainly to lawyers and judges.
Abstract
Individual decisions dealt with identification practices used in lineups and other situations, the right to counsel, the waiver of the right to counsel and subsequent self-representation, interference with the right to counsel, conflicts of interest, and ineffective assistance of counsel. Other decisions dealt with the right to a speedy trial and the right of public access to criminal proceedings. Decisions focusing on confrontation focused on the right of the defendant to attend all trial proceedings, the use of hearsay evidence, the opportunity to confront or cross-examine child witnesses, and restrictions on the opportunity for cross-examination. Decisions related to the defendant's right to compulsory process focused on the right to call witnesses, the right to introduce secondary forms of evidence, and other issues. 459 footnotes.
