This document provides a comprehensive overview and recommendations of the Florida Parole and Probation Commission.
Abstract
The Commission recommends that (1) The process for the early release of inmates should be modified; (2) Parole eligibility should be extended to inmates sentencing guidelines; and, (3) The role of the Parole and Probation Commission should be expanded. The SB131 bill, enacted in the Legislature during the 1987 session, granted the Commission authority to transact business anywhere in the State, providing expanded opportunities for citizens', victims', and criminal justice agencies' participation in the parole process. A recent development in parole law included the decision by the Florida Supreme Court that the rights due to a defendant in a criminal prosecution do not apply to parole revocation. Therefore, indigent parolees are not entitled to counsel in all parole revocation proceedings. Rather, the right to counsel must be determined on a case-by-case basis.
