The New York State Division of Criminal Justice Services and the Crime Victims Board is required by law to compile and review information transmitted by the Division of Probation and Correctional Alternatives and other agencies on the number of restitution and reparation orders issued in New York, the number satisfied, and crime types for which restitution is ordered.
Abstract
During 1985 and 1986, both the number of restitution orders issued and the number satisfied increased. Requests for victim impact information, victim responses to these requests, and the number of statements forwarded to sentencing courts increased 100 percent from 1985 when reporting was first required through 1986. Victim impact statements played a central role in informing the courts of victim views regarding case disposition. Most victims were willing to submit victim impact information, and victim service programs operating in 58 New York counties provided an array of services, including support and advocacy. Offenders usually had the financial resources to pay at least a portion of the restitution victims requested and were legally entitled to receive. The administration of restitution in New York is discussed in terms of collecting restitution, monitoring offender compliance with restitution orders, disbursing restitution to victims, and fiscal management and recordkeeping. Appendixes provide supplemental data on restitution offenses and victim impact statements and services. 29 references, 49 tables, 1 figure.
