The assumption of risk doctrine in the law of third-party consent searches is discussed in light of the recent United States Supreme Court ruling in Illinois v. Rodriguez.
Abstract
In this article, the authors extend their application of social psychology to consent law by describing significant discrepancies between judicial assumptions about lay perceptions of risk and consent and actual lay consensus. 32 footnotes (Author abstract)
