Since the law of criminal justice administration continues to develop since publication of the main volume in 1986, this casebook supplement primarily contains decisions of the U.S. Supreme Court during 1987 and 1988.
Abstract
The first part covers the investigation of crime, focusing on the exclusionary sanction, fourth amendment prohibition against unreasonable search and seizure, constitutional doctrines related to law enforcement conduct, the issuance and execution of arrest and search warrants, and warrantless searches. The first part also encompasses electronic surveillance, interrogation and confessions, self-incrimination and Miranda rights, sixth amendment right to counsel, undercover investigations, and grand jury investigative functions. The second part considers prosecution and adjudication, with emphasis on bail and preventive detention, discretion to prosecute, preliminary examination and grand jury, competency to stand trial, discovery and disclosure, and right to an impartial trial. This part further explores joinder and severance of charges, double jeopardy, pretrial hearings, plea bargaining, adjudication of guilt or innocence by trial, effective assistance of counsel, sentencing, and appeal. A table of cases is included
