This reference work designed for lawyers, judges, and law enforcement and corrections officials discusses the law in North Carolina concerning sentencing, but excluding capital punishment. General topics covered include the choice of sentence and the ways in which sentences are executed, the service of prison and jail sentences, probation, parole, work release, restitution, and community service as well as the legal authority of probation and parole officers.
Abstract
Authorized sentences in North Carolina must fall within certain constitutional limitations; the types of sentences include quasi-sentences, fines and costs, probation, and active prison or jail terms. Sentencing procedures are based on plea bargaining, standard sentencing information, the Fair Sentencing Act which governs felony sentences, and guidelines for sentences for impaired driving. Other sections of this book cover modifications and corrections to sentences; execution of prison sentences; the administration of probation, parole, fines, and quasi-sentences; and other post-conviction matters relating to firearms laws, loss and restoration of citizenship rights, and expunction of records.
