A symposium held at the annual meeting of the members of Justice, the British Section of the International Commission of Jurists, dealt with the topical issue of the criminal justice process and the prevention of miscarriages of justice.
Abstract
The discussion used the recent public attention focused on three spectacular cases of miscarriages of justice -- the Guildford Four, the Maguires, and the Birmingham Six -- as a starting point to compare the British criminal justice system with those in Scotland, France, Germany, and the Netherlands. The focus of the symposium was to compare the relative merits and disadvantages of the inquisitorial system favored by many European countries with the British common law system which many legal experts are now trying to reform.
