This book, outlining the constitutional mandates applicable to both Federal and State law enforcement officers, is designed for officers who have the task of protecting, seeking, and preparing evidence for use in court.
Abstract
The opening chapter discusses repercussions of failure to comply with constitutional mandates including civil liabilities, civil rights actions, and admissibility of evidence. Police power and limitations are discussed in terms of police responsibility, the Bill of Rights, due process of law, expanded scope of the fourteenth amendment due process clause, and State constitutional protections of rights. The subsequent sections discuss specific details of the common constitutional questions that confront law enforcement officers. These issues include police authority to detain, law of arrest, search and seizure with a warrant and without a warrant, questioning suspects, and pre-trial identification procedures. 1 appendix and chapter references
