This chapter of the Texas Code deals with emergency management and is designed to reduce the vulnerability of people and communities to natural or manmade catastrophes, prepare for prompt and efficient rescue and care operations, provide procedures for rapid and orderly restoration and rehabilitation, clarify and strengthen the roles of the governor and various State agencies, and provide an overall emergency management system.
Abstract
The powers and duties of the governor encompass inter alia, executive orders, declaration of a state of disaster, suspension of procedural laws and rules, use of public and private resources, movement of people, and Federal aid for local governments. The chapter on division of emergency management deals with State emergency management plans, assistance in development of local plans, temporary personnel, assistance to aviators, communications, and weather monitoring. Financial issues are covered as are issues related to local and interjurisdictional emergency management. The chapter on disaster prevention focuses on the governor's duties, State study of land use and construction standards, and recommendations for changes in these procedures. Another chapter discusses citizen duties and claims for compensation, while miscellaneous provisions deal with insurance coverage and penalties for violating the emergency management plan.
