Fiscal year 1991-92 was the first full year of operation for the Control Release Program; just over 38,000 cases were reviewed by the Commission. Although large numbers of offenders are being released by the program, the Commission has identified the more assaultive and dangerous offenders to serve the maximum amount of time within their court-imposed sentence. Over 50 percent are being release with terms and conditions of supervision to provide for public protection. The Commission and its staff continued as the investigative arm of the Governor and Cabinet as the Board of Executive Clemency. Clemency Rule revisions were adopted effective January 1, 1992 which expanded the Commission's duties regarding capital cases and female inmates who claim the "battered woman syndrome." There continues to be an increase in requests for clemency as a result of more incarcerated offenders being ineligible for any other form of early release consideration. As a result of legislation that passed in the last session, the Commission will be considering cases recommended by the Department of Corrections for release under the new Conditional Medical Release Program. Financial data are also provided. Data encompass the clemency administration workload, the parole grant workload, the field services workload, the revocation workload, and the general counsel workload.
