This paper describes various examples of British provisions designed to ensure that the maximum number of juveniles possible are released on bail and others are provided relevant alternative facilities.
Abstract
One of the ways to ensure that more juveniles are released on bail when appropriate is to begin the collection of background information on defendants as soon as possible after charges are brought. This early gathering of information not only increases the likelihood of bail being granted; it also allows the local authority to make early decisions about an appropriate placement should there be remand to care. Bail support schemes also provide for various structures of pretrial release designed to bring compliance with bail conditions. These may include provisions such as supervision, the monitoring of school attendance, liaison with employment services, and the use of family resources. When bail is deemed inappropriate, a range of alternative placements should be available so as to avoid placing a youth in a community home. Some alternatives are remand lodging for youth who have nowhere to live in the community, foster homes, therapeutic communities, outdoor adventure courses, and independent living in local housing with intensive social work support. So as to ensure that the least intrusive intervention is used, a structure of decisionmaking criteria should be established in each jurisdiction to ensure consistent decisionmaking that complies with official policy.
