This resource book is a concise guide to the principal rules and the tactical considerations that guide civil lawsuits in the U.S. Federal courts.
Abstract
The exposition focuses on the meaning and consequences of the statutes, court rules, and leading decisions. Sources are provided for the reader to pursue when the situation requires more detailed discussion than is feasible in a single reference volume. Part one contains eight chapters on Federal courts and procedure. The topics discussed are the Federal judicial system, Federal court jurisdiction, venue and transfer, pleading, joinder of claims and parties, provisional remedies, pretrial procedure, and motion practice. Part two contains six chapters that address the various procedures associated with pretrial discovery in civil proceedings. One chapter explains the purpose, procedures, and scope of discovery, followed by chapters on depositions, interrogatories, requests for production and inspection, physical and mental examinations, and requests for admissions. Part three contains five chapters on trial and appeal in Federal civil proceedings. A chapter on trial procedures is followed by four chapters on special proceedings, judgments, post-trial proceedings, and appeal procedures.
