This article reexamines the dangerousness debate and considers the implications for all involved in Britain's penal system.
Abstract
The 1991 Criminal Justice Act (CJA) has brought about a sentencing reform more fundamental than previously perceived as possible in legal history but is so riddled with inconsistencies that progress is highly debatable. The seriousness of the crime remains a central criteria for sentencing, particularly for crimes of violence and sexual offenses, but a real risk exists that "seriousness" and "dangerousness" will become blurred. The overall effect is that offenses that fall within this category will be penalized more heavily. "Key players" in the process will find their role either enhanced or decreased. 23 references
