The authority for counties to condemn exists in Minnesota statutes. Whether the acquisition of property is by negotiation or condemnation, preacquisition activities are similar. These activities involve identifying and describing the parcels affected, the nature of interest to be taken, identifying landowners and interest holders, and preliminary appraisal. Procedures for acquisition by condemnation encompass county board action, formal appraisal, condemnation petition and notice, condemnation hearing, and payments. Other condemnation-related procedures focus on appeals, final certificate, and compelling acquisition and inverse condemnation. An appendix contains forms for use in condemnation proceedings.
