The 1992 annual report of California's Commission on Judicial Performance, an independent State agency that handles complaints involving judicial misconduct and disability, provides information on disciplinary activities during 1992, case disposition, and voluntary disability retirement.
Abstract
The commission's primary duty is to investigate charges of willful judicial misconduct in office, persistent failure or inability to perform judicial duties, habitual intemperance in the use of intoxicants or drugs, conduct prejudicial to the administration of justice, and other improper actions or derelictions of duty. During 1992, the commission received 966 complaints, ordered 136 staff inquiries and 15 preliminary investigations, and instituted formal proceedings in two cases. The commission issued 40 advisory letters, 11 private admonishments, and three public reprovals. During 1992, the commission did not approve or deny any applications for voluntary disability retirement. Appendixes provide supplemental information on the commission's governing provisions, a list of case citations, flow charts of commission proceedings, and a complaint form.
