This primer describes existing correctional education practices and defines intended outcomes for youth receiving special education within the criminal justice system.
Abstract
The first section summarizes statutory and regulatory requirements to provide a free and appropriate education to incarcerated youth with disabilities. In addition, it outlines some important legal rulings that should guide State and local educational agencies who attempt to meet their obligations under these statutes. These legal requirements are based on the Individuals With Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act of 1973, and the Americans With Disabilities Act. The second section discusses current practices in selected jurisdictions across the country. The document contains several interagency agreements that establish clear channels of communication and delineate the scope of responsibility of relevant educational and correctional agencies. Issues which may be addressed include financial arrangements, coordination of services and records, evaluation, and technical assistance. The final two sections cover funding and personnel issues, and resources. They also include an annotated bibliography, experts, information centers, resource list, and selected articles.
