This report summarizes State statutes, current through 1991, regarding the admissibility of videotaped depositions or testimony in criminal child abuse cases.
Abstract
These statutes authorize videotaped testimony in lieu of live testimony at a criminal trial and specifically refer to either the child's deposition, preliminary hearing, grand jury proceeding, or other sworn testimony. Entries for each statute include the crimes specifically listed within the statute, victim's age as specified, applicability, criteria for admission, factors to be considered in determining "good cause," persons who may be present at the videotaping of the testimony, and special issues. Each entry also includes an annotation of any rulings on the statute's constitutionality by the applicable court.
