The legislative history of the Public Safety Officers Benefits Act of 1976 is reviewed.
Abstract
The act was introduced to amend the Omnibus Crime Control and Safe Streets Act of 1968 in order to provide benefits to survivors of certain firefighters who die in the performance of duty. Congressional comments on the act are provided, and specific provisions of the act are indexed. These provisions concern direct and proximate payments, personal injury, line of duty, performance of duty, spouse benefits, interim benefits, repayment and waiver, and taxation. Limitations of the act are also noted that relate to intentional misconduct, intention to bring about death, voluntary intoxication, beneficiary actions, and gross negligence. Definitions of terms used in the act are included.
