The role of strategic and tactical professional judgment in developing a pretrial discovery master plan is addressed in this textbook, primarily in the context of applicable Federal Rules of Civil Procedure.
Abstract
Each chapter of the textbook leads the reader through the chronology of using the pretrial discovery device in question. At each major step in the chronology, chapters highlight choices facing the litigator and address considerations that may influence the litigator's choice. The focus is on prudential cost-benefit analysis rather than on either knowledge of procedural law or legal policy analysis. Problems are included at the end of each chapter to test the reader's appreciation of the range of choices open to a client and considerations relevant to the choice. The textbook covers pretrial discovery in general, strategic pretrial discovery planning, informal pretrial discovery tactics, dispositions, interrogation, physical and mental examinations, protective orders, and sanctions. Case studies are appended.
