Prepared for a 1991 training conference for judges in New England, this course book presents dozens of articles, sample judicial orders, jury instructions, and State laws related to environmental offenses, environmental law enforcement, and court proceedings on these issues.
Abstract
An introduction notes that the area of environmental law is growing perhaps faster than any other part of the law today; each new environmental law creates multiple rights and multiple rights of action. The training conference focused on judicial decisions related to environmental law, the technical and scientific issues involved in environmental cases, and legal issues in environmental cases. Specific topics included the taking issue, the administrative process and the role of the courts in enforcing environmental law, insurance and liability issues, site investigation procedures, wetlands values and identification, and site remediation. Several discussions focused on a case study of Carlisle Metal Shredding v. Department of Environmental Protection. Glossary
