Certain provisions of the Law Enforcement Act of 1993 (H.R. 3355) are analyzed, particularly in relation to sentencing goals articulated by Congress in the Sentencing Reform Act of 1984 and Federal sentencing guidelines.
Abstract
A brief discussion, pertinent recommendations, and information on prison impact are provided for four general areas of the Law Enforcement Act: (1) three-time loser provisions; (2) gun crime penalties; (3) drugs and minors; and (4) low-level drug defendant safety valve. The analysis specifically considers proportionality concerns in sentencing, enhanced penalties for crimes involving semiautomatic firearms, firearms possession by violent felons and serious drug offenders, mandatory prison terms for violent crimes, automatic assault weapons, sale of illegal drugs to minors, and nonviolent drug offenses. The analysis also covers miscellaneous sentencing provisions, such as supervised release after imprisonment and the revocation of supervised release and probation. 63 footnotes, 10 tables, and 5 figures
