This collection of texts describes the practical procedures the European Community (EC) has developed to respond to numerous attempts to defraud it.
Abstract
The first part examines the judicial context of EC fraud: the national and European levels of jurisdiction, the different EC funds and ways they can be defrauded, and the collaboration among the different member countries to ensure that agricultural and customs regulations are followed. A special section raises the question why Belgium so rarely prosecutes EC fraud. The second part focuses on EC control mechanisms and the administrative measures against fraud. It explains the financial management of EC agriculture as well as the role of several central inspection agencies and customs officials in preventing fraudulent subsidies and penalizing violations. The third part is devoted to police and judicial action; it explains the training and use of national court officials, lawyers, and police officers in investigating and prosecuting EC fraud cases. The fourth section focuses on international cooperation in the EC including different treaties and their restrictions. It also establishes models for future international rogatory agencies. The final section outlines different laws protecting the rights of the defendant.
