This document presents and explains a model State code on domestic assault; the code focuses both on protecting victims in a fair, prompt, and comprehensive manner and on preventing future violence in every family where such violence has been discovered.
Abstract
The code sets forth procedures for comprehensive civil protection orders consistent with due process. The code considers domestic and family violence as a crime that requires early and thorough intervention. Where the custody of a child is an issue, the child assures that the child's safety and well-being are of paramount concern. Finally, it sets forth ways that each community can coordinate efforts to identify, protect, treat, and intervene when domestic assault occurs. Individual sections define offenses, discuss penalties, specify the duties of law enforcement officers and prosecutors, victims' rights, presumptions concerning custody, the use of mediation, the creation of a State advisory council, the establishment of a State public health plan for reducing domestic assault, and training for professionals.
