This annotation analyzes reported cases in which the courts have interpreted or determined the validity or effect of a statute, ordinance, or other regulation either imposing or authorizing the imposition of a curfew that is limited to minors.
Abstract
Included within the annotation are cases involving laws expressly designated as curfew laws, as well as cases involving any other law which prohibits juveniles from being, traveling, remaining, or loitering on the streets or other specified places after a certain time of day or between certain hours. The claims against juvenile curfews relate to general restrictions of personal liberty interests, restriction of particular personal liberty interests, interference with parental rights or family autonomy, denial of equal protection, and vagueness. The annotation discusses particular terms referring to prohibited activities and to exceptions to regulation, as well as the effect of curfew regulations on tort action. 47 notes
