This curriculum is intended as a guideline for the delivery of performance-based law enforcement training in search-and- seizure procedure under California and U.S. law.
Abstract
The instructional goals of the curriculum are to provide students with knowledge of the protection provided by the U.S. and California Constitutions against unreasonable searches and seizures of people, houses, and personal property, as well as circumstances under which searches and seizures can be conducted. The required topics are terminology/concepts related to searches and seizures, conditions under which a search can be made without a warrant, conditions/limitations under which a search can be made with a warrant, observations, probation and parole searches, searches and seizures associated with vehicles, closed container searches, and identification procedures. Another topic addressed is the use of force/compulsion to conduct a search and/or recover evidence. Students must be provided with a minimum of 12 hours of instruction. For each of 19 topics, this booklet outlines the instruction material. Performance objectives and supporting material and references are provided.
