This document explains the provisions of Part II of the Criminal Justice and Public Order Act 1994, which includes a series of changes designed to toughen the law on granting bail in the United Kingdom.
Abstract
Section 25 provides that a defendant charged with actual or attempted murder, manslaughter, or rape who has a previous conviction for any of these offenses or for culpable homicide must automatically be refused bail. Section 26 removes the statutory presumption in favor of bail when the defendant is charged with an indictable or either-way offense allegedly committed while on bail. Section 27 gives police custody officers the power to grant conditional bail to people who have been charged, using the same basis and criteria as courts do, but with certain exceptions. Section 28 makes the criteria for refusing police bail similar to those for refusing court bail.
