This supplement to the 1991 publication, "Law of Sentencing, Probation, and Parole in North Carolina," summarizes 1993 and 1994 State legislation, principally the Structured Sentencing Act and related measures, including those enacted in the 1994 Extra Session on Crime.
Abstract
This preliminary edition of the supplement does not include legislation enacted during the 1994 Regular Session, which began May 24. Following a brief history of sentencing legislation, the establishment and operation of the Sentencing Commission is discussed. A review of the provisions of the Structured Sentencing Act addresses the purposes of sentencing, authorized types of sentences, sentencing procedure, modifying and correcting sentences, and the execution of sentences. Legislation pertinent to the classification of offenses and recent changes in punishment is also explained, including the Revised Habitual Felon Law and the new Violent Habitual Felon Law. Provisions of the Criminal Justice Partnership Act are also discussed. This is companion legislation to the Structured Sentencing Act. Its goals are to reduce offenders' recidivism, alcoholism, and drug dependency, as well as reduce probation revocations and incarceration costs for the State and counties. 36 notes and appended tables
