North Carolina has enacted legislation that identifies responsibilities of the Division of Criminal Statistics (DCS) and that contains provisions on criminal record expungement, the handling of intelligence information records in criminal investigations, access to public and criminal records, and data security and privacy.
Abstract
The DCS is charged with collecting and correlating information pertinent to criminal law administration, including information on crimes, arrests, preliminary hearing dispositions, prosecutions, convictions, acquittals, punishment, appeals, and offender characteristics. The DCS is also responsible for collecting and maintaining access to information that will facilitate the administration of criminal justice throughout North Carolina. Complementing the work of the DCS are the Police Information Network and the State Bureau of Investigation. Additional legislation covers criminal record expungement based on offense type, access to public and criminal history records, criminal investigation records, criminal record confidentiality, and procedures for assuring data security and privacy.
