Maine has enacted legislation that defines responsibilities of the State Bureau of Investigation (SBI), covers fingerprinting and uniform crime reporting, requires courts to submit criminal records to the SBI, and contains provisions on criminal history record information (CHRI).
Abstract
The SBI is responsible for collecting and maintaining fingerprints and other CHRI pertinent to the identification of individuals who have been arrested as fugitives from justice or who have been arrested or charged with a criminal offense. Law enforcement agencies are charged with taking fingerprints of such individuals and submitting these to the SBI, and law enforcement agencies are also responsible for uniform crime reporting. Further, courts must submit criminal records to the SBI. Maine's Criminal History Record Information Act defines CHRI as information on the arrest, detention, and indictment of an individual. Records on detained persons must be maintained that include identity of the arrested person, time and place of arrest, and circumstances of the arrest. Legislation limits the dissemination of CHRI and intelligence and investigative information, gives individuals the right to criminal record access and review under certain circumstances, and provides for data security and safety.
