Louisiana has enacted legislation that deals with criminal identification and information, public records and recorders, and criminal record privacy and security.
Abstract
Legislation has created the Louisiana Bureau of Criminal Identification and Information (BCII) within the Department of Public Safety. The BCII has a criminal records and identification section, a field services and quality assurance section, and a latent fingerprint section. The BCII is required to provide criminal history records and files to the appropriate individuals and agencies, although it must restrict the release of juvenile information. In addition, the BCII must protect the right of individual access to criminal records, maintain data system security, obtain and file fingerprint and identification data, and compile statistics and information. Louisiana legislation also contains provisions on the maintenance of public records, individual privacy rights, criminal history checks, individual right of access to both manual and automated criminal history record information, and criminal history record completeness and accuracy.
