South Dakota has enacted legislation that contains provisions on criminal identification, the collection and maintenance of criminal statistics, and access to criminal records and files.
Abstract
The Attorney General is responsible for compiling criminal identification information, in cooperation with law enforcement. Criminal identification information includes fingerprints, prisoner records, and court records of felony and misdemeanor convictions. Legislation authorizes the collection of criminal information by the Bureau of Criminal Statistics (BCS). The BCS collects data on crimes committed in South Dakota, the extent and character of juvenile delinquency, police operations, prosecuting attorneys, courts, correctional facilities, probation, and parole. The BCS can authorize the destruction of criminal records and access to these records by law enforcement and other criminal justice agencies. Legislation covers access to and review of criminal records and files, the completeness and accuracy of criminal records, criminal histories, and criminal information reporting requirements.
